By accessing or using any website, mobile application, or service provided by Home X Buyers (“Home X Buyers”), you agree to comply with and be bound by these Terms of Use. This agreement constitutes a legally binding contract between you and Home X Buyers, including any referenced Privacy Policy. If you do not accept these terms, you are not permitted to use any Home X Buyers website or services.
The digital platforms and mobile applications operated by Home X Buyers (together called “Platforms”; individually, a “Platform”) provide multiple solutions, including those featured and explained across our Platforms (the “Solutions”).
Home X Buyers maintains the exclusive right to modify this Agreement at any time and may alter, pause, or update any feature of our Platforms without prior notice. These changes could involve adjustments to content, user access levels, or the removal of certain platform functions. By continuing to use our Platforms after we post updates to these Terms, you automatically agree to comply with all revised provisions.
1. CERTIFICATION OF USER.
By accessing or using this platform, you confirm to Home X Buyers that you either reside in the United States or are legally permitted to conduct business there, have reached the age of majority (at least 18 years old), and possess the legal authority to enter into this binding agreement.
2. CONTENT AND REGISTRATION.
2.1. The term “Platform Content” refers to all elements, sections, and materials available through Home X Buyers’ digital services, including but not limited to: written content, statistical data, photographic images, visual designs, video materials, and any other resources accessible via our Platforms (collectively termed “Materials”). This encompasses all digital infrastructure operated by Home X Buyers, along with any subscriptions, software tools, service offerings, or informational resources provided through our company’s channels.
2.2 Third-Party Provider Materials – Home X Buyers maintains business relationships with select third-party providers, including sponsors, advertisers, and product/service suppliers (“Providers”). Through these partnerships, our platform may feature or link to promotional offers, informational content, products, or services supplied by these Providers (“Provider Materials”). Home X Buyers makes no representations or warranties regarding the availability, accuracy, or quality of such Provider Materials, and does not endorse, guarantee, or assume responsibility for any Provider’s offerings or services.
2.3 Home X Buyers shall not be responsible for any direct or indirect damages resulting from your use of: (a) any third-party websites linked through our platform, (b) Provider Content, or (c) products/services offered by Providers. Any descriptions or statements regarding Home X Buyers’ solutions featured on our platform should not be interpreted as formal offers, but rather as invitations for potential business opportunities.
2.4 Account Registration – While some platform content remains accessible without registration, full access to all features and services requires creating an account with a unique username and password. You accept full responsibility for maintaining the security of your login credentials and agree to: (1) keep this information confidential, (2) be the sole authorized user of your account, and (3) use your account exclusively for accessing Home X Buyers’ platform and services. We retain the right to monitor account activity and may suspend or terminate access at our discretion. In case of any suspected unauthorized access to your account, you must immediately update your security credentials and notify our team.
3. LIMITATIONS ON USE AND USER SUBMISSIONS.
3.1 Intellectual Property Rights. All materials, content, and digital assets provided through the Home X Buyers platform, including but not limited to text, images, designs, multimedia elements, software code, interface configurations, and proprietary methodologies are protected under intellectual property laws. All content and materials available through the Home X Buyers platform are protected by intellectual property laws and may not be directly or indirectly copied, reproduced, modified, performed, displayed, sold, transmitted, published, broadcast, or redistributed through any medium, whether currently existing or developed in the future. This prohibition expressly includes but is not limited to practices such as screen scraping or database scraping to extract user lists or other proprietary information. Users may not store any portion of this content on computer systems or distribute it across networks, except that you may download or print a single copy of platform pages strictly for personal, non-commercial use – provided that any such printed materials must include the Home X Buyers copyright notice. The Home X Buyers name, logos, page headers, custom graphics, buttons, and other distinctive branding elements are registered and unregistered trademarks, service marks, and trade dress of Home X Buyers. All other product names and company logos featured on the platform remain the intellectual property of their respective owners and are used for identification purposes only.
3.2 Home X Buyers respects the intellectual property rights of others and maintains a policy that may result in the termination of user access to our services if we determine, in our sole discretion, that infringement has occurred – whether for first-time or repeat violations, regardless of whether the material is ultimately found to be infringing. We have established procedures for addressing copyright infringement claims. If you believe your copyrighted work has been reproduced on our platform without authorization, please provide written notification including: (1) identification of the copyrighted work claimed to be infringed; (2) identification of the allegedly infringing material and its location on our platform; (3) your contact information; (4) a statement that you have a good faith belief the use is unauthorized; and (5) a statement that the information in your notice is accurate. Such notifications should be sent to our designated agent at copyright@homexbuyers.com. We may remove or disable access to allegedly infringing material while investigating valid claims.
3.3 Acceptable Use Policy – You agree to utilize the Home X Buyers platform and its content solely for lawful purposes. You are prohibited from posting, transmitting, or distributing any material that: (1) violates intellectual property rights, including patents, trademarks, or copyrights, or infringes upon others’ privacy or publicity rights; (2) contains unlawful, threatening, abusive, defamatory, obscene, or otherwise objectionable content; or (3) incorporates protected material without the owner’s explicit authorization. You acknowledge and accept full responsibility for any legal consequences, damages, or liabilities arising from your violation of these terms or any harm caused by your use of our services. Any unauthorized use of protected content may result in immediate termination of your access and potential legal action.
3.4 User Content License – By submitting any messages, materials, or communications through Home X Buyers’ platform or via email, you grant us a perpetual, irrevocable, global license to use, modify, distribute, and display your content. This royalty-free, non-exclusive license allows us to: (1) reproduce and adapt your submissions; (2) create derivative works; (3) publish or translate the content; and (4) incorporate your materials into any current or future media formats. This authorization applies to all or part of your communications and extends to any technologies now existing or later developed.
3.5 User-Generated Content – All discussion forums and interactive features on the Home X Buyers platform are proprietary systems owned by Home X Buyers and do not constitute public forums. You acknowledge that any content posted by third parties (including text, files, images, videos, audio, or other materials) represents solely the views and responsibility of the original poster. As a user, you bear complete legal responsibility for all content you submit, share, or transmit through our services. Home X Buyers disclaims all liability for third-party content and prohibits the use of our platform to:
- Transmit unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, privacy-invasive, hateful, or discriminatory content
- Engage in any conduct that could harm minors
- Impersonate any person/entity or misrepresent your affiliations
- Forge headers or manipulate identifiers to disguise content origin
- Share confidential/proprietary information without proper authorization
- Infringe on intellectual property rights (patents, trademarks, copyrights, etc.)
- Distribute unsolicited advertising, spam, chain letters, or pyramid schemes
- Upload malware or any disruptive code/files
- Disrupt normal user interactions or platform functionality
- Interfere with service operations or connected networks
- Violate any applicable local/national/international laws
- Stalk or harass other users
- Collect personal data about other users without consent
You acknowledge and agree that Home X Buyers may retain any third-party content submitted through our platform and reserves the right to disclose such content when we reasonably believe it’s necessary to: (a) comply with legal obligations; (b) enforce our Terms of Service; (c) address claims that content infringes on others’ rights; or (d) protect the safety, rights, or property of Home X Buyers, our users, or the general public.
You are prohibited from using any Home X Buyers logos, trademarks, or proprietary content in your links without our express written permission. Linking to our platform is restricted when such links:
3.6. Linking – Without the prior written consent of Home X Buyers, you may not use any of Home X Buyers’ proprietary logos, trademarks, or other distinctive graphics, video, or audio material in your links. You may not link to the platform or to any page thereof or engage in the practice of “deep linking” in any manner reasonably likely to: (a) imply any false affiliation with or endorsement or sponsorship by Home X Buyers; (b) cause confusion, mistake, or deception among users; (c) dilute the strength of Home X Buyers’ trademarks or service marks; (d) otherwise violate applicable state or federal laws; or (e) constitute improper disparagement or unauthorized disclosure concerning Home X Buyers or any of its respective affiliates, or their respective officers, directors, agents, franchises, or partners. Furthermore, you may not frame or otherwise incorporate into another website any of the content or other materials from our platform without obtaining Home X Buyers’ prior written consent.
4. ACCESS AND DELAYS IN SERVICES
Home X Buyers, its affiliates, subsidiaries, and partners shall have no obligation to maintain your access to the platform. Neither Home X Buyers nor its related parties shall be liable for any direct or indirect damages resulting from service interruptions, delays, inaccuracies, or errors, including those caused by: equipment failures, telecommunication problems, technical defects, severe weather, labor strikes, natural disasters, civil disturbances, armed conflicts, acts of terrorism, or any other circumstances beyond reasonable control.
5. MONITORING BY Home X Buyers.
You acknowledge that Home X Buyers reserves the right to monitor any and all third-party content transmitted through its platform for lawful purposes. This monitoring may include examining, recording, copying, and utilizing such content for authorized business operations. All user-generated content, including personal information shared on or transmitted through our services, remains subject to such monitoring. By accessing or using the platform – whether authorized or not – you expressly consent to this monitoring activity and agree to comply with all other terms outlined in this Agreement.
6. REPRESENTATIONS, WARRANTIES AND LIMITATION OF LIABILITY
6.1. General Disclaimer and Limited Warranty – You acknowledge that some information, third-party content, and links provided through the Home X Buyers platform may originate from sources outside our control. While this content is generally considered reliable, all parties recognize that inaccuracies may occur. Home X Buyers, its licensors, and partners make no warranties regarding the accuracy, completeness, or suitability of such information. Neither Home X Buyers nor its licensors or partners guarantees or endorses the reliability of any content distributed through our services.
You acknowledge and agree that the Home X Buyers platform is provided strictly on an “AS IS” basis with all faults and potential defects. Home X Buyers and its partners expressly disclaim all warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, non-infringement, or those arising from trade practice or course of dealing. Furthermore, Home X Buyers makes no representation or warranty that the platform will meet your specific requirements, be suitable for your needs, or produce any particular results.
6.2. You accept full responsibility for any errors, omissions, or inaccuracies in the platform’s content, including any issues arising from data transmission or conversion processes. You agree to establish and maintain your own verification procedures to ensure the platform’s information meets your specific accuracy and suitability requirements. This includes maintaining independent systems for data backup, recovery, and any necessary reprocessing or analysis of information obtained through our services.
6.3. Viruses – YOU ACKNOWLEDGE AND AGREE THAT Home X Buyers employs commercially reasonable measures to prevent viruses and similar malicious programs from affecting the platform or its content. HOWEVER, YOU EXPRESSLY ACCEPT SOLE RESPONSIBILITY FOR (AND HEREBY RELEASE Home X Buyers FROM ANY LIABILITY RELATED TO) IMPLEMENTING YOUR OWN PROTECTIVE MEASURES TO DETECT, REMOVE, AND GUARD AGAINST ANY VIRUSES OR MALICIOUS PROGRAMS THAT MAY AFFECT YOUR SYSTEMS THROUGH USE OF THE PLATFORM.
6.4. LIMITATION OF LIABILITY – YOU AGREE THAT HOME X BUYERS AND ITS AFFILIATES, SUBSIDIARIES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES RESULTING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM FOR ANY PURPOSE. SHOULD THESE LIABILITY LIMITATIONS BE DEEMED INEFFECTIVE FOR ANY REASON, HOME X BUYERS’ MAXIMUM AGGREGATE LIABILITY SHALL BE LIMITED TO THE GREATER OF: (A) 10% OF THE TOTAL AMOUNTS YOU PAID TO HOME X BUYERS UNDER THIS AGREEMENT; OR (B) $100.00. THIS LIQUIDATED DAMAGES AMOUNT CONSTITUTES THE SOLE AND EXCLUSIVE REMEDY, APPLICABLE EVEN IF HOME X BUYERS HAS BEEN ADVISED OF POTENTIAL DAMAGES. THESE LIABILITY PROVISIONS SHALL REMAIN IN FULL FORCE FOLLOWING ANY TERMINATION OF THIS AGREEMENT.
6.5. FTC NOTICE – CERTAIN STATE LAWS MAY RESTRICT THE ABILITY TO LIMIT THE DURATION OF IMPLIED WARRANTIES, IN WHICH CASE THE WARRANTY LIMITATIONS ABOVE MAY NOT APPLY TO YOU. ADDITIONALLY, SOME JURISDICTIONS DO NOT PERMIT THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THESE PROVISIONS MAY NOT BE ENFORCEABLE IN YOUR AREA. THESE WARRANTY TERMS PROVIDE SPECIFIC LEGAL RIGHTS, AND YOU MAY POSSESS OTHER PROTECTIONS THAT DIFFER DEPENDING ON YOUR STATE OF RESIDENCE.
7. INDEMNIFICATION
You agree to fully release, discharge, and hold harmless Home X Buyers, its affiliates, subsidiaries, partners, and all their respective members, shareholders, directors, employees, agents, representatives, vendors, and contractors (collectively referred to as “Indemnified Parties”) from any and all claims, demands, losses, liabilities, and causes of action of any kind, including reasonable attorneys’ fees and legal expenses, arising from or related to your access or use of the platform or any information obtained through it. This indemnification obligation applies regardless of whether such claims result from, in whole or in part: (a) your actions or omissions; (b) the negligence (whether sole, joint, concurrent, or gross) of any party; (c) strict liability; (d) third-party contractual obligations; or (e) any other fault (active or passive) of any person or entity, including but not limited to the Indemnified Parties. You further agree to provide reasonable cooperation in the defense of any such claims.
8. PRIVACY POLICIES
These Terms of Use include our Privacy Policy as contained on our website, which is incorporated fully herein.
9. UNSOLICITED MARKETING.
9.1. Unsolicited Marketing – Home X Buyers is committed to responsible digital commerce practices. The platform expressly prohibits any use of its services to transmit, distribute, or facilitate unsolicited communications of any kind, including but not limited to commercial emails, non-commercial bulk messages, junk electronic communications, or any form of SPAM. No user is authorized to employ Home X Buyers’ services for such purposes under any circumstances.
9.2. Electronic Direct Marketing Programs – Home X Buyers may develop and participate in targeted electronic marketing campaigns for platform users who opt-in to receive communications about products and services relevant to their interests. In compliance with this Agreement, Home X Buyers does not share, sell, or disclose user contact information (including email addresses) with third parties. Participating advertisers specify the demographic categories of users most likely to be interested in their offerings, and Home X Buyers delivers these advertisements only to opted-in users matching those criteria. Users may unsubscribe from these communications at any time either by: (1) selecting the opt-out option included in every marketing email; or (2) sending a removal request to our support team at unsubscribe@homexbuyers.com. This ensures users maintain complete control over their communication preferences.
9.3. Reporting Unwanted Communications – Users who receive SPAM, threatening messages, or offensive emails through our platform may report these communications by forwarding the complete, unaltered message (including full headers) to our abuse prevention team at abuse@homexbuyers.com.
9.4. Reservation of Rights – Home X Buyers expressly reserves the right to implement any technical measures or pursue legal action necessary to prevent the transmission of unsolicited communications (including SPAM, junk mail, threatening content, or any other messages deemed inappropriate at our sole discretion) through our platform. We further reserve the right to immediately suspend or terminate access for any user found to be violating these anti-spam provisions, as determined by Home X Buyers in its absolute discretion. No failure or delay by Home X Buyers in exercising these rights shall constitute a waiver of our ability to enforce them at any time.
10. MISCELLANEOUS
10.1. Governing Law; Limitations; Venue – This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws provisions that might apply the laws of another jurisdiction. Any legal action or proceeding arising from or relating to your use of the platform must be filed within two (2) years of when the claim first accrued, to the fullest extent permitted by applicable law. All such claims shall be litigated exclusively in either the state courts of Dallas County, Texas or the United States District Court for the Northern District of Texas, and you irrevocably: (a) consent to personal jurisdiction in these courts; (b) appoint the Texas Secretary of State as your agent for service of process if required; and (c) waive any objection to venue or forum non conveniens in these jurisdictions.
10.2. Assignment Restrictions – You may not transfer, delegate, or assign any rights, duties, benefits, or obligations under this Agreement without obtaining Home X Buyers’ prior written consent. Any attempted assignment or transfer without such consent shall be automatically void and without legal effect. This prohibition applies to all assignments, whether voluntary, involuntary, by operation of law, or otherwise, except as expressly permitted in this Section 10.2.
10.3. Severability – If any provision of this Agreement is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be automatically reformed to the minimum extent necessary to make it valid and enforceable while preserving its original intent to the fullest extent possible. If reformation is not feasible, the provision shall be severed from this Agreement without affecting the validity, legality, or enforceability of the remaining provisions, which shall continue in full force and effect.
10.4. Third-Party Service Fees – You acknowledge that accessing and using the Home X Buyers platform may result in charges from your telecommunications provider, internet service provider, or other third-party services. These charges may include, but are not limited to, data usage fees, messaging costs, and other connectivity expenses. You accept full responsibility for all such charges incurred through your use of our services, and agree that Home X Buyers shall have no liability for any communications-related fees or expenses you may incur.
10.5. Termination – Home X Buyers reserves the right to suspend or terminate your access to the platform at any time, with or without cause, in our sole discretion. Such termination shall not prejudice any legal rights or remedies available to Home X Buyers under applicable law or equitable principles. Upon termination of this Agreement: (a) all licenses and permissions granted to you shall immediately cease; and (b) all rights shall automatically revert to Home X Buyers without further action required.

California Electronic Commerce Notice – California users may contact the California Department of Consumer Affairs at 1625 North Market Blvd., Sacramento, CA 95834, or by phone at (702) 909-2422 for complaints regarding electronic commerce services or information about consumer rights under California Civil Code §1789.3.
10.8. Entire Agreement – This Agreement becomes fully effective upon your initial use of the platform and represents the complete and exclusive understanding between you and Home X Buyers, superseding all prior or contemporaneous agreements, representations, or understandings (whether written or oral). Should any conflict arise between this Agreement and subsequently published terms, the most recent version of our terms of use as officially published by Home X Buyers shall govern.
ALL RIGHTS NOT SPECIFICALLY GRANTED TO YOU UNDER THIS AGREEMENT ARE EXPRESSLY RETAINED AND RESERVED BY HOME X BUYERS.
